1.1 Incorporation of personal data into All We Wear Group's files

In accordance with the provisions of the current regulations on Personal Data Protection, we inform all persons who register or submit their application (hereinafter "Candidates") to the job offers of All We Wear Group, that all personal data provided by the Candidate will be incorporated into the files owned by All We Wear Group for the purposes of a human resources department, i.e. the management of their application in the various selection processes.

The completion of all the requested data is necessary to achieve an optimal provision of the services made available to the Candidate. If not all the data is provided, All We Wear Group does not guarantee that the information and services requested can be provided correctly or meet the needs of the Candidate.

The Candidate guarantees that the information provided to All We Wear Group is correct and complete, and must keep it updated at all times, exempting All We Wear Group from the consequences and damages that the inaccuracy of the same may cause to others and / or third parties.  All We Wear Group reserves the right to review the Candidates' data.

 

2. WHAT PERSONAL DATA DO WE PROCESS?
 
All information collected by All We Wear Group will be treated fairly, lawfully and transparently.
 
Also, the data requested in each of the treatments carried out will consist only of those strictly necessary to carry out the intended purpose and informed in each case, not being further processed in a manner incompatible with those purposes.
 
Thus, the data collected will be adequate, relevant and not excessive in relation to the purposes for which they are processed in each case. In general terms, within the framework of the various processing activities carried out in the organization, the following data are collected:

We use this information to manage selection and recruitment, and to assess your suitability for the position for which you have applied. This data will also be used to plan your probationary and on-boarding period.
 

3. WHERE DOES THE PERSONAL DATA COME FROM?

As a general rule, personal data are always collected directly from the owner of the same, however, in certain exceptions, the data may be collected through third parties, entities or services other than the interested party.

In this regard, this will be communicated to the interested party through the informative clauses contained in the different information collection channels.

4. PURPOSES OF PROCESSING 

We process your personal data in order to manage the selection process. 

For this purpose, we carry out different processing: 

  • Recruitment chatbot: Conducting interviews through the chatbot. As well as interacting with future candidates.
  • Evaluation and scoring of resumes: Scoring of CVs, in relation to the criteria established by the company.
  • Interviews conducted by AI: Interview with the candidate. The platform generates specific questions depending on the job offer.
  • Conclusions of the candidate: Finished the interview, the AI system, generates a document about the candidates that fit the profile.
  • Talent pool: Storage of cv's for future needs. 

5. LEGITIMACY FOR THE PROCESSING OF PERSONAL DATA

Pre-contractual relationship: 

The legitimizing basis for managing the application of data subjects is the implementation of pre-contractual measures. 

Consent to processing

Once the selection process has been completed, the candidate may give his or her consent to store his or her CV for future selection processes. Also, the candidate must express, freely, the transfer of their personal data to other companies within the same business group of All We Wear Group, "(A list of group companies is attached in Annex). 

6. RETENTION PERIODS

If your application for employment is not selected, we will keep your data in our HR systems for 1 year after the end of the relevant selection process. At the end of this period, or if you withdraw your consent before then, your data will be deleted or destroyed.

If your application for employment is successful, the personal data collected during the recruitment process will be transferred to your HR file and retained for the duration of your employment with the company. You will be informed of the retention periods of your data in our employee privacy policy.

7. WITH WHOM DO WE SHARE PERSONAL DATA?

Your information will be shared internally for the purposes of the recruitment process. This includes members of the HR and Talent Acquisition teams, interviewers involved in the selection process, business area managers and anyone else who needs to access the data to perform their functions.

The data provided by the Candidate may be accessible by third parties, only in cases where the selection process is outsourced and always ensuring adequate security measures for the processing of the Candidate's personal data.

If you are selected, All We Wear Group will share your data with third parties to obtain references from previous jobs in other companies as part of the selection process.

We will transfer your data outside the European Economic Area (EEA), as some of our systems, such as Talenteria, are hosted outside the EEA, namely in the United States. However, the tool has taken all necessary measures to protect your personal information in accordance with its privacy policy, implemented as measures to protect personal information, the use of the European Commission's Standard Contractual Clauses for transfers of personal information between group companies and external suppliers. 

These clauses require all recipients to protect all personal information they process from the EEA or the UK in accordance with European data protection laws and regulations. 

8. PROFILING AND AUTOMATED DECISIONS

For the management of the recruitment process, the Organization will rely on profiling and automated decision making.  

The recruitment technology applied will be based on comparing the information provided by the candidate with that required by the organization (comparing what the company requests with what the candidate offers). 

AI-based scoring rules will be used for candidate selection. The company will select certain requirements and criteria for the job (skills, experience, languages, etc.) and the recruiting tool reviews the description and selects candidates according to the criteria the organization has established (called "matching scores").

9. DO WE PROCESS YOUR DATA WITHOUT HUMAN INTERVENTION?

No, we will not make any decisions about you based solely on automated processing (i.e., without human involvement) that have a legal or similarly significant effect on you. 

The cases in which we apply processes involving decision-making based on automated processing are detailed in the section on purposes of processing. You may request human intervention in the automated decision-making process, as appropriate, through dataprivacy@awwg.com or the relevant system or platform where you can express your opinion and, where appropriate, challenge the decision. 

10. EXERCISE OF RIGHTS

The Candidate may exercise the rights of access, rectification, cancellation, limitation, opposition, portability and the right not to be subject to automated decisions, including profiling, by means of a written communication addressed to All We Wear Group Carretera Laureà Miró, 403-405-08950 Sant Feliu de Llobregat; or by e-mail addressed to dataprivacy@awwg.com. In both cases, the Candidate must attach a copy of his/her national identity card, passport or other valid document that identifies him/her.

In any case, you can request the protection of the Spanish Data Protection Agency through its website.

11. PROHIBITION FOR CANDIDATES OUTSIDE LEGAL AGE

The services offered by All We Wear Group are intended for persons who are within the legal working age. The Candidate acknowledges that he/she is of legal age. Otherwise, we urge the Candidate to leave the website immediately.

12. OBLIGATIONS OF THE CANDIDATE

The Candidate undertakes to the truthfulness and accuracy of the data he/she provides, to keep them updated and is responsible for communicating to All We Wear Group any changes to them.

The Candidate is responsible for the personal data of third parties that may be included in the files of All We Wear Group. In this regard, the Candidate must obtain their prior and express consent, having informed them of the terms contained in this Privacy Policy. The Candidate agrees to hold harmless All We Wear Group against any possible claim, fine or penalty that may be forced to bear as a result of the breach by the Candidate of the duty described in this paragraph.

The Candidate also undertakes to indemnify All We Wear Group against any possible claim, fine or sanction that it may be obliged to bear as a consequence of the breach by the Candidate of this Privacy Policy.

13. INTELLECTUAL AND INDUSTRIAL PROPERTY

All the contents of this website, understanding these merely by way of example, the texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the "Content"), are the intellectual property of All We Wear Group or the companies of the group, without any of the exploitation rights recognized by the current legislation on intellectual property on the same, except those that are strictly necessary for the use of this employment service, can be understood to be transferred to the Candidate.

The trademarks, trade names or distinctive signs are owned by the All We Wear Group or group companies, without it being understood that access to this employment service attributes any right over such trademarks, trade names and / or distinctive signs.

14. SECURITY

All We Wear Group maintains security levels of personal data protection in accordance with current regulations.

All We Wear Group will not be liable for damages caused as a result of any technical failure in the services provided or products purchased caused by the very nature of the Internet or your device, including, but not limited to, loss, misuse, alteration, unauthorized access, theft, fire, flood or any other force majeure event that may affect the data.

15. MODIFICATION OF THIS PRIVACY POLICY

All We Wear Group reserves the right to modify this Privacy Policy for any legal adaptation to future legislative or jurisprudential developments, as well as industry practices.

In any case, we will communicate to the Candidates by email such changes.
